David Moyes' post match comments appeared to hint at a bias of the referee, a similar offence to which cost the Latics manager a £10,000 fine.
The Everton boss was annoyed with the handling of Marouane Fellaini's numeous incidents on Saturday as the big midfielder walked the red card tight rope.
"I think Roberto has done a good job over the last few days of making sure that the referees have given them what was required.
"Fellaini needs more protection. He was two foot above Figueroa and anyone who has played the game knows you need to use your arms to get elevation.
"I can't understand why when we have a corner what Fellaini would be doing to the Wigan players? Why would he be trying to foul?"
The game finished 2-2 after former Latics player Leighton Baines' penalty drew scored level in the last ten minutes.
